Please read the following statements to understand how your personal information will be treated when you fully utilize the websites and services of 3DNET / ElderCare & subsidiaries. Our Privacy Policy describes how 3DNET / ElderCare collects, uses, shares, and secures the personal information you provide. It also describes your choices regarding use, access, and correction of your personal information. The websites of 3DNET / ElderCare & subsidiaries are owned and operated by 3D Network Company International Inc. ("e-Court").

3DNET / ElderCare and all of its subsidiaries are fully compliant with the EU General Data Protection Regulation (GDPR) .

The EU General Data Protection Regulation (GDPR) applies from 25 May 2018, when it replaces the current national data protection laws of all EU member states. The Regulation is important and has a broad scope and brings a 21st century approach to data protection. It expands the rights of individuals to determine how their personal information is collected and processed, and imposes a range of obligations on organisations to make them more accountable for data protection.

Broader scope

The GDPR applies to all EU organisations – whether commercial companies, charities or public bodies – that collect, store or process the personal data of EU residents, even if they are not EU citizens. Organisations based outside the EU that offer goods or services to EU residents, monitor their behaviour or process their personal data are covered by the GDPR. Changes to this policy

We may update this policy from time to time. If we do, we will let you know if there are any material changes, either by notifying you on the site or by sending you an email. New versions of this policy will never apply retroactively: we will let you know the exact date on which they will come into effect. Your continued use of 3DNET/ElderCare after a change means that you accept this policy.

Who we are

The 3D Network Co. Int'l Inc, and its and their parents, subsidiaries, affiliates, agents, representatives, consultants, employees, officers and directors — collectively ("e-Court," "we," or "us") provide online services that help individuals, businesses, organizations, governments resolve their conflicts, disputes and/or provide other counseling services. Its services consist of an online platform that enables parties to resolve their differences and/or obtain other counseling services through vetted legal and non-legal professionals. The latter do not have any employment relationship with 3DNET / ElderCare and/or its subsidiaries. These professionals subcontract their services to 3DNET / ElderCare for an indefinite period of time, as such they are independent/neutral from e-Court. 3DNET / ElderCare assumes no legal responsibility for these services and/or the impact they may have on any party. We are a Public Benefit Corporation headquartered in Ottawa, Ont. How this policy applies

This policy describes the information we collect from you, how we use that information, and our legal basis for doing so. It also addresses whether and how that information may be shared, and your rights and choices regarding the information you provide to us. If you see a capitalized word, it is in our Terms of Use . We use cookies and similar technologies, as described in our Cookie Policy .

By using e-Court's services, you acknowledge that you agree to our Terms of Use and that you have read and understood this Privacy Policy and our Cookie Policy.

What we collect and receive

In order to create an account on 3DNET/ElderCare and use our services, we need to collect and process certain information. Depending on your use of the services, that may include:

  • Information that you provide by filling in forms on 3DNET / ElderCare — your name, email and postal address, telephone number, country of residence, login and password information. We may ask for this information when you register as a user of the Services, subscribe to our newsletters, upload or submit content via e-Court, or contact us;
  • Information you provide for identity verification purposes when starting a project, including your legal name, business name and tax ID for business entities, and date of birth. In some cases, our payment processor will ask you to securely upload proof of identity (such as your passport, driver's license, or other government-issued ID) to e-Court;
  • Information about any requests or transactions you make through the Services. 3DNET/ElderCare partners with other companies (such as RBC) to process payments. The payment information you provide will be collected and used by them in accordance with their privacy policies (for RBCs, click here ). 3DNET/ElderCare does not store your payment information, except for the last four digits of your credit card or bank account (if applicable), the expiration date, and country, which we require for tax, government regulatory, and security purposes;
  • Information about your activities on and interactions with e-Court, including use of our mobile apps (such as your IP address, the type of device or browser you use, and your actions on the Site);
  • Information about the ways in which people visit and interact with our site, in the form of traffic analytics. You can opt out of being included in Google Analytics here . For more information about our use of data analytics to protect and improve our services, see our Cookie Policy ;
  • Communications you send to us (for example, when you request support, send us questions or comments, or report a problem);
  • Information you provide on or to 3DNET / ElderCare in the form of comments, contributions to discussions or messages to other users; and
  • The email address associated with your Facebook account, if you choose to log in with your Facebook credentials. 3DNET/ElderCare will also ask for permission to access your name, profile picture, and friends list (these permissions are governed by Facebook's privacy policy and can be managed through your Facebook privacy settings). We will never post anything to your Facebook, Twitter, or other third-party accounts without your permission.

You may decline to provide us with your information. However, this will limit your ability to register for an account or use our services. You can pledge to a project as a guest by providing only an email address. However, to edit your pledge, save payment information for future pledges, post project comments, and perform most other actions on our site, you will need to create an account. You can view, change, or delete your information through your account settings .

How we use this information

We use the information we collect for the following purposes:

  • To keep your account secure and protect our services (including verifying applicants' identities and preventing fraud and abuse);
  • To enable us to provide you with our services and to improve and promote our services;
  • To create and manage your account, contact you, and personalize your experience on 3DNET/ElderCare (for example, to show you projects that we think may interest you based on your past usage); and
  • To track and analyze the use of the Services so that we can improve the performance of 3DNET / ElderCare and provide users with the best possible experience.

Users from the European Union

Data protection laws in Europe require a “lawful basis” for collecting and retaining personal information from citizens or residents of the European Economic Area. Our lawful bases include:

  • Performance of the agreement we have with you: In certain circumstances, we need your personal data to fulfil our contractual obligation to provide the Services, to enable casemakers to set up and showcase their projects, and to enable funders to find and make commitments to them.
  • Legal Compliance: Sometimes the law tells us to collect and use your information. For example, tax laws require us to keep records of commitments and payments made through our services.
  • Legitimate interests: This is a technical term in data protection law which essentially means that we have a good and fair reason to use your information and that we do so in ways which do not harm your interests and rights. Sometimes we need to use your information to pursue our legitimate interests in a way that might reasonably be expected as part of running our business and which does not materially impact on your rights, freedoms, or interests.

    For example, we use identity, device and location data to prevent fraud and abuse and to keep the Services secure. We may also send you promotional communications about our Services, subject to your right to control whether we do so.

    We analyse how users interact with our site so that we can better understand which elements of the design work well and which don’t. This allows us to improve and develop the quality of the online experience we provide to all our users.

How this information is shared

Information shared publicly

When you create an account, we create a basic profile page for you on e-Court, which includes your username, the date your account was created, and a list of projects you have supported or launched. By default, your profile is private, and you can choose to make it public in your account settings. Your username will appear on the comments you make and messages you send on 3DNET/ElderCare, and if your profile is set to public, people can click on your username to view it. If you make your profile public, others will be able to see the following:

  • The username you select for the account and the date the account was created;
  • Any information you decide to add to your profile (such as a photo, biography or your location);
  • Projects you have supported (but not the amounts pledged or rewards chosen);
  • Projects you have created;
  • Comments you have posted on e-Court; and
  • If you like a project update.

If you want to have a public profile, but don't want others to see your name or profile picture on a project's Community tab, you can choose an account picture or name that is not identifiable (e.g. CatLuvr88). You can change or remove certain information associated with your account (such as your username, profile picture, bio, and location) through your account settings . You can also change your privacy settings if you want to make your profile private or customize the default settings.

Case creators are also asked to verify their identity before launching a project. Once this is done, the creator’s verified name will be publicly displayed on their account profile and on any projects they launch.

Information not shared publicly

The following information is not displayed publicly or disclosed to other users:

  • Any payment information you provide;
  • Your password information;
  • Your IP address;
  • Your telephone number;
  • Your date of birth and other identity verification documentation (for case creators);
  • Private profile information, in accordance with your preferences; and
  • Communications you send to us (for example, when you request support, send us questions or comments, or report a problem).
Information shared with trusted third-party services

We may share your information with certain trusted third party services to help us provide, improve, promote, or protect e-Court’s services (such as when we partner with payment processors or use services that help us manage our advertising on other sites). When we share data with third party services that support our provision of the 3DNET/ElderCare services, we require that they use your information only for the purposes that we have authorized and that they protect your personal information to at least the same standards that we do. We may also share information that has been aggregated and anonymized in a way that does not directly identify you.

Information shared with case developers and employees

When you back a project, the project creator knows your username, the amount you pledged, and the reward you selected. The project creator never receives the credit card information or other payment information from the sponsors.

If a project you have backed is successfully funded, the creator will receive the email address associated with your 3DNET/ElderCare account. They may also send you a survey requesting information necessary to provide your reward. (For example, they may need your mailing address or T-shirt size.) Any information you provide in such surveys will be received by the creator.

Case Creators are required to keep backer information confidential except as strictly necessary to communicate directly with backers and fulfill rewards. Case Creators may not ask for personal information that is not necessary to provide your reward, and may never ask for sensitive personal information such as your social security number or payment information. Please contact us at support@e-court.ca if you receive a request for information that seems inappropriate or excessive.

Collaborators are third parties that Case Creators may employ to help manage their project. These collaborators may have access to information available to Case Creators (including Backers’ names, email addresses, pledge amounts, reward selections, messages, and survey responses) and must treat Backers’ personal information with the same care and respect as Case Creators.

Casemakers and their collaborators can also receive routine traffic analyses of their project pages.

Information shared to protect 3DNET/ElderCare and comply with the law

We reserve the right to disclose personal information when we believe it is reasonably necessary to comply with the law or law enforcement, to prevent fraud or abuse, or to protect the legal rights, property, or safety of e-Court, its employees, users, or others.

Links to other websites and services

Our site may contain links to other websites or services whose privacy practices may differ from those of e-Court. When you link to an external site or service, the privacy policy and data processing disclosures for that site or service will apply.

Preservation

We will retain your information for as long as your account is active, as needed to provide you the services, or as otherwise set forth in this Policy. We will also retain and use this information as necessary for the purposes set forth in this Policy and as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and protect e-Court's legal rights.

We also collect and maintain aggregated, anonymized or pseudonymized information that we may retain indefinitely to protect the safety and security of our Site, improve our services, or comply with legal obligations.

Data transfers

Because 3DNET/ElderCare is a Australia-based company, your information is collected and processed in Australia. Australia has its own laws governing data protection and government access to information. The rules that protect your personal information under Australian law may differ from those in your home country. If you choose to use the Services, you must agree to our Terms of Use, which sets out the contract between 3DNET/ElderCare and its users.

Your rights

Users who reside in certain countries, including the EU, are granted certain rights regarding their personal information. Unless an exception or exemption applies, these rights include the ability to access, correct, and request deletion of your personal information. While these rights do not apply globally, all 3DNET/ElderCare users can manage their personal information, as further described below, in their account settings .

You may request a downloadable copy of your personal information from 3DNET/ElderCare through your account settings page. To change or delete the personal information you have provided to us, please log in and update your profile. You may also delete your account through your account settings page. We may retain certain information as required by law or as needed for our legitimate business purposes.

Email and mobile notifications

We only want to communicate with you if you want to hear from us. We try to keep emails to a minimum and give you the opportunity to opt-in to any marketing communications we send.

We will send you emails regarding your transactions on e-Court. You may also opt-in to receive certain marketing email communications, in accordance with your preferences, and you may opt-out at any time by adjusting your notification settings . If you download the 3DNET/ElderCare app, you can manage the notifications you receive on your mobile device in your profile settings.

We will also send you service-related communications when necessary.

Security

We take security seriously and the security of your personal information is important to us. We follow industry standard practices to protect the information we collect and maintain, including the use of Transport Layer Security (TLS) to encrypt information as it is transmitted over the Internet. No method of transmission over the Internet or method of electronic storage is completely secure, so 3DNET/ElderCare cannot guarantee its absolute security. Your account information is protected by a password, which you should choose carefully and keep secure. We encourage all users to enable two-factor authentication in their account settings to further protect their account.

We have a Security Incident Response Team (SIRT) and protocol in place in the event of a data breach. We encourage responsible disclosure of vulnerabilities of our services by emailing support@e-Court.ca, and we invite valid disclosures to our bug bounty program.

Children

Persons under the age of 18 (or the legal age in your jurisdiction) are not permitted to use 3DNET/ElderCare on their own. 3DNET/ElderCare does not knowingly collect personal information from children under the age of 13, and children under the age of 13 are not permitted to register for an account or use our Services. If you believe that a child has provided us with personal information, please contact us at support@e-court.ca . If we learn that a child under the age of 13 has provided us with personally identifiable information, we will delete it.
